Waste Removal Camberwell Terms and Conditions

These Terms and Conditions govern the provision of waste removal and related services by Waste Removal Camberwell to domestic and commercial customers within its service area. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, company or organisation requesting waste removal or related services.

Company means the waste collection service trading as Waste Removal Camberwell.

Services means the collection, removal, loading, transportation and disposal or recycling of waste, as agreed with the Customer.

Booking means a confirmed request by the Customer for the Company to provide Services, whether made by phone, email, online form or any other accepted method.

Waste means any rubbish, junk, household waste, garden waste, office waste, construction waste or other materials agreed to be collected by the Company, excluding any prohibited items set out in these Terms and Conditions.

2. Scope of Services

The Company provides waste collection and removal services within its designated service area, including but not limited to Camberwell and surrounding neighbourhoods. Services may include one-off rubbish collection, regular scheduled collections, bulky item removal, garden waste clearance, office clearance and similar waste-related work as agreed with the Customer.

The Company will only collect waste that has been accurately described and agreed at the time of booking. Any additional items or substantially different types or volumes of waste presented at the time of collection may result in additional charges or refusal to collect some or all of the waste.

3. Booking Process

Bookings may be made by telephone, email or through an online enquiry and confirmation process, where available. When making a booking, the Customer must provide clear and accurate information, including but not limited to:

a) The collection address and any access restrictions.

b) The approximate volume and type of waste to be removed.

c) Any heavy, bulky, hazardous or unusual items.

d) Preferred dates and times for collection.

The Company will provide an estimated price based on the information given by the Customer. This estimate is not a fixed quote and may be adjusted at the time of collection following a physical assessment of the waste.

A booking is only confirmed when the Company has accepted the request and communicated confirmation to the Customer. The Company reserves the right to decline any booking at its sole discretion.

4. Access and Customer Responsibilities

The Customer is responsible for providing safe, reasonable and lawful access to the waste to be collected. This includes ensuring that:

a) The waste is located on the Customer’s property or at a location where the Customer has full authority to grant access.

b) Any gates, doors or access points are unlocked or an authorised person is present at the agreed time.

c) Parking or stopping arrangements for the Company’s vehicle are available and lawful.

The Customer must ensure that waste is presented in a safe manner, free from sharp or dangerous protrusions where reasonably possible, and separated where requested, for example separating general rubbish from recyclable materials or green waste.

If safe and reasonable access is not available at the agreed time, or if the collection cannot proceed due to circumstances within the Customer’s control, the Company may charge a call-out fee or apply its cancellation terms.

5. Pricing and Payments

Prices are based on factors such as the type and volume of waste, labour involved, access conditions and any additional services requested. The Company may provide price guides for typical collections; however, the final price is normally confirmed after inspection of the waste on site.

Unless otherwise agreed in writing, payment is due on completion of the collection, prior to departure from the site. The Company may accept card payments, bank transfers or cash, subject to availability and any applicable conditions communicated at the time of booking.

For commercial Customers or regular contracts, the Company may offer invoicing terms subject to credit checks and agreed payment periods. Late payment may incur interest and administrative charges in accordance with applicable UK legislation.

The Customer is responsible for all charges arising from the Services, including any additional fees for extra waste, waiting time or aborted collections, as reasonably determined by the Company.

6. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting the Company as soon as reasonably possible. The following cancellation rules will normally apply, unless otherwise stated at the time of booking:

a) Cancellations or major amendments made more than 24 hours before the scheduled collection time will usually not incur a cancellation charge.

b) Cancellations made less than 24 hours before the scheduled collection time may incur a reasonable cancellation fee to cover allocated resources and lost time.

c) If the Company arrives at the site and is unable to complete the collection due to reasons within the Customer’s control, including lack of access, incorrect address details or absence of an authorised person where required, the Company may charge a call-out fee and, if a re-visit is requested, an additional collection fee.

The Company reserves the right to amend or cancel a booking due to circumstances beyond its control, including but not limited to severe weather, vehicle breakdowns, staff illness, safety concerns or compliance requirements. In such cases, the Company will make reasonable efforts to notify the Customer and to rearrange the collection at a mutually convenient time. The Company will not be liable for any direct or indirect losses arising from such amendments or cancellations, save as required by law.

7. Waste Types and Prohibited Items

The Company will collect most non-hazardous household and commercial waste, including general rubbish, furniture, appliances, garden waste and similar materials. Certain items are prohibited or subject to special handling, including but not limited to:

a) Asbestos or materials suspected to contain asbestos.

b) Clinical or medical waste.

c) Chemicals, solvents, oils, fuels, paints or pressurised containers, unless specifically agreed.

d) Hazardous or toxic substances, including certain electrical and electronic equipment where specific disposal requirements apply.

e) Gas bottles, explosives, ammunition or any items presenting an immediate risk to health and safety.

The Customer must declare any potentially hazardous or regulated waste in advance. If, during collection, the Company reasonably believes that waste includes prohibited items or presents a health, safety or environmental risk, it may refuse to collect all or part of the waste and may recover any reasonable costs incurred as a result.

8. Compliance with Waste Regulations

The Company operates in accordance with applicable UK waste management legislation, including duty of care requirements for the handling, transport and disposal of controlled waste. All collected waste will be taken to authorised facilities for reuse, recycling, recovery or disposal, as appropriate.

The Customer confirms that they are the owner of the waste or are otherwise authorised to arrange its removal. By engaging the Company, the Customer transfers control and responsibility for the waste to the Company at the point of collection, subject to the terms of these conditions.

The Customer agrees to provide any information reasonably required by the Company to comply with waste regulations, including descriptions of the waste and any known hazards. Where required, the Company may issue documentation such as waste transfer notes in accordance with the relevant regulations.

9. Liability and Limitations

The Company will exercise reasonable skill and care in providing the Services. However, to the fullest extent permitted by law, the Company’s liability is limited as follows:

a) The Company shall not be liable for any loss, damage, cost or expense arising from inaccurate, incomplete or misleading information provided by the Customer.

b) The Company shall not be liable for any pre-existing damage to property, driveways, access routes, fixtures, fittings or items that are moved or handled in the normal course of providing the Services.

c) The Customer acknowledges that waste removal vehicles may need to access private driveways or narrow roads. The Company will take reasonable care, but shall not be liable for damage to surfaces, paving or underground services caused by the normal operation and weight of vehicles, unless due to the Company’s negligence.

d) The Company shall not be liable for any indirect or consequential losses, including loss of profit, business interruption, loss of opportunity or reputational damage.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

If the Company is found liable for any loss or damage suffered by the Customer, its total aggregate liability in respect of any single event or series of connected events shall, to the extent permitted by law, be limited to the total fees paid by the Customer for the specific Services giving rise to the claim.

10. Customer Property and Personal Items

The Customer is responsible for ensuring that no personal belongings or items of value are left in or among the waste set aside for removal. The Company is not required to check or search through items presented as waste and shall not be liable for the loss of any item disposed of in error.

If the Company discovers any obvious personal documents or items of potential value, it may, at its discretion, attempt to notify the Customer or return such items, but this is not a guaranteed service and shall not alter the Customer’s responsibility.

11. Health and Safety

The Company is committed to operating safely and to protecting its staff, Customers and the public. If, in the opinion of the Company’s staff, any situation at the collection site presents an unacceptable risk to health or safety, the Company may refuse to proceed or may modify the way the Services are delivered.

The Customer agrees not to place staff under undue pressure to undertake unsafe lifting, climbing, access or manoeuvring. Where necessary, the Company may adjust charges to reflect additional safe working measures required.

12. Data Protection and Privacy

The Company will handle personal information in accordance with applicable data protection laws in the United Kingdom. Personal data may be collected for the purposes of handling enquiries, processing bookings, providing Services, managing accounts and complying with legal obligations.

The Company will take reasonable steps to keep personal information secure and will not sell or share personal data with third parties other than where necessary for service delivery, payment processing, debt collection, legal compliance or with the Customer’s consent.

13. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as reasonably possible, providing full details of the issue. The Company will investigate the complaint and aim to provide a response or proposed resolution within a reasonable timeframe.

Both parties agree to make reasonable efforts to resolve disputes amicably. If a dispute cannot be resolved, either party may pursue its rights through the courts or other appropriate channels.

14. Variations to These Terms

The Company reserves the right to amend these Terms and Conditions from time to time to reflect changes in law, industry practice or the nature of its Services. The version in force at the time of the Customer’s booking will normally apply to that booking.

Any significant variations specifically agreed in writing between the Company and the Customer shall take precedence over these general terms to the extent of any inconsistency.

15. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by the Company.

By confirming a booking or allowing the Company to commence work, the Customer acknowledges that they have read, understood and agreed to these Terms and Conditions for waste removal services.
